Procedure to recover debts in Russia simplified for Belarusian citizens

The process for Belarusian citizens to recover debts in Russia has been simplified. This is due to the entry into force of an agreement between Belarus and Russia regarding the mutual enforcement of court decisions made by courts in both countries, which was signed in Moscow on 18 December 2024, the Belarusian Justice Ministry told BelTA.

The agreement is another international treaty that streamlines debt recovery in Russia.
Belarusian creditors can now submit enforcement documents issued by Belarusian courts (such as writs of execution and court orders) in Russia without going through a special recognition process.
Under the agreement, court decisions in civil cases and criminal cases, as far as they relate to civil claims, which require the debtor to pay money to the creditor, including government fees, other court fees, and procedural costs, are enforceable.
The agreement does not apply to enforcement documents that, in addition to monetary obligations, contain non-monetary requirements.
As the Justice Ministry explained that in order to enforce a Belarusian court ruling in Russia, the creditor must apply to the enforcement department of the regional or Minsk city executive committee with a request to forward the enforcement document to the relevant territorial office of the Russian Federal Bailiff Service.
In addition, Russia will enforce court rulings on alimony recovery and rulings of economic courts without a special recognition procedure.
